The May meeting was well-attended. Attorney Joley Eason provided an interactive presentation on estate planning, and particularly addressed unique issues that can arise from being a resident of Virginia, which has state laws which differ from the laws of surrounding states. Some of these differences were surprising, and Ms Eason answered many questions from the attendees concerning special circumstances.

Estate Planning is an important aspect of the life of a lung disease sufferer. Ms Eason discussed:

  1. What is a trust? Is there a minimum for a trust?
  2. The 5 year "Look Back" rules for trusts and medicaid
  3. When you should use a small estate affidavit
  4. Should joint accounts have 'right of survivorship'?
  5. What is the distribution process of an estate?
  6. Why you have to qualify as an executor
  7. Why a Will only covers probate assets
  8. Issues for 401K accounts, Stocks and Bank accounts
  9. How does Power of Attorney work in Virginia?
  10. "Gifting" limitations
  11. What is an Advance Medical Directive
  12. What "Living Wills" really are under under the law

Joley L. Eason is an associate with the law firm of ThompsonMcMullan in Richmond.

She practices in the areas of estate and disability planning, estate and trust administration, fiduciary litigation, guardianship and conservatorship of disabled and incapacitated adults, Medicaid and long-term care planning, Medicare counseling and advocacy, and Social Security, Disability, Supplemental Security Income and pension benefit assistance.

A native of Marion County, Georgia, Joley graduated from the College of William & Mary in Williamsburg, Virginia, with a dual Bachelor of Arts degree in the Thomas Jefferson Program in Public Policy and Sociology. Thereafter, she received her law degree and a Certificate in Health Law from the University of Pittsburgh School of Law in 2012.

During law school, she interned for the University of Pittsburgh Elder Law Clinic, and gained experience in guardianship, estate planning, and Social Security, Medicare, and Medicaid issue resolution. She also interned for the State Health Insurance Assistance Program, and counseled Medicare participants in plan selection and benefits.

Ms. Eason participates in a number of organizations, and serves on the Elder Law Section Council of the Virginia Bar Association, the Board for the Metropolitan Richmond Women’s Bar Association, and the Multidisciplinary Panel for Jewish Family Services Public Guardianship Program. She chairs a monthly meeting for Richmond Elder Law Attorneys, and volunteer as an attorney for LINC, JusticeServer, Senior Connections, and the Virginia National Guard Service Program. She has written several publications for the National Business Institute and Virginia Lawyers Weekly, and is a frequent speaker on elder law topics such as Medicare, Medicaid, guardianship, estate and long-term care planning.

She received the 2014 Krista Latshaw Volunteer Attorney of the Year Award from LINC for her pro bono volunteer work for cancer patients and their families.
